The judge is putting an end to the Nathan Wade/Fani Willis drama in the case against Trump and his co-defendants — sort of.
The conflict of interest between them is real, and their professional relationship in the Trump prosecution is compromised….
In his ruling, Fulton county superior court judge Scott McAfee wrote that district attorney Fani Willis had demonstrated “tremendous lapse in judgment”, noting that even if the romantic relationship between her and Nathan Wade developed after Wade was appointed as special prosecutor in November 2021, Willis “chose to continue supervising and paying Wade while maintaining such a relationship.”
She further allowed the regular and loose exchange of money between them without any exact or verifiable measure of reconciliation. This lack of a confirmed financial split creates the possibility and appearance that the District Attorney benefited – albeit non-materially – from a contract whose award lay solely within her purview and policing.

This finding is by no means an indication that the Court condones this tremendous lapse in judgment or the unprofessional manner of the District Attorney’s testimony during the evidentiary hearing. — Guardian
So far as the ruling itself, his ‘split the baby’ solution is to require that one or the other of them no longer serve on this case.
A Georgia judge has ruled that embattled Fulton County District Attorney Fani Willis must either step aside from the case against former President Donald Trump or fire special prosecutor Nathan Wade.
Fulton County Superior Court Judge Scott McAfee issued the ruling after hearing evidence presented by lawyers for the co-defendants in the sweeping 2020 election interference case. Four co-defendants accused Willis of having an “improper” affair with Nathan Wade, whom she hired to help prosecute the case.
McAfee said that the defendants “failed to meet their burden of proving that the District Attorney acquired an actual conflict of interest in this case through her personal relationship and recurring travels with her lead prosecutor.”
“However, the established record now highlights a significant appearance of impropriety that infects the current structure of the prosecution team – an appearance that must be removed through the State’s selection of one of two options,” he wrote. — FoxNews
John Turley reacted to this decision by comparing it to a scenario where police found two people in a bank vault and carried one of them away to jail.
At the time of writing, the prosecution has not responded to the ruling, but Trump’s lawyer has made it clear they will continue to push for the removal of both parties from this case, with the ideal outcome being a full dismissal.
The undeclared $150 donation Judge McAffee once made to Fani’s campaign may come into play in any appeal of this decision.
This isn’t the only headache for Fani. For anyone who may have missed it, Congress is threatening to slap Contempt of Congress charges against her if she fails to provide the information they subpoenaed about the details of how she has been spending federal money.
It’s still a little too early to say for sure whether this is a win, a loss, or a draw for the defendants. But Trump will continue the fight.
