This scathing ruling couldn’t come at a worse time for the Democrat narrative.
The left has been telling us for years that the GOP is a ‘threat to democracy’. Now, a judge has ruled in court that reality is exactly the opposite.
An Ohio judge just gave a smack-down ruling to Democrats who literally arrested their political opponent… because they didn’t like how she was behaving as an elected official!
It’s a story that almost fell through the cracks while everyone’s attention was turned toward the convention in Iowa.
U.S. District Court Judge J. Philip Calabrese found in favor of Commissioner Niki Frenchko, and her claim that her Constitutional rights had been violated.
The people who were found guilty of violating her Constitutional rights were colleagues who had her arrested after she criticized the sheriff. This judge’s message should be part of every Republican political campaign in 2024… because her situation looks an awful lot like the one many other conservatives have found themselves in, since the ‘Resistance’ crowd has declared on Trump and anyone aligned with him.
“Here in America, we do not arrest our political opponents,” Judge Calabrese wrote. “This case tests that longstanding norm as well as our Constitution’s robust protections for free speech that allow us to criticize our representatives and public officials. Plaintiff Niki Frenchko won election to the three-member Board of County Commissioners of Trumbull County, Ohio. She was an outsider, and the only member of County government from her political party. As a public official, she used her position to needle the incumbents and, in her view, hold them accountable for their decisions. For their part, they viewed her as ignorant of the basic workings of county government and a nuisance, to put it mildly.”
Frenchko was arrested by two sheriff’s deputies during a July 2022 commissioners meeting, after she was critical of Sheriff Paul Monroe.
The deputies told Frenchko she was disrupting the public meeting. She was removed from the meeting and handcuffed.
The charge was later dismissed. Frenchko filed the federal lawsuit last March. She is represented by attorneys David Betras and Matt Miller-Novak.
Betras said the federal judge found that former Trumbull County commissioner Frank Fuda and current commissioner Mauro Cantalamessa, the sheriff and the two deputies “willfully violated Commissioner Niki Frenchko’s rights under the First and Fourth Amendments to the U.S.
“The judge also stripped them of their sovereign immunity, which means they can be held individually liable for monetary damages,” Betras told the FOX 8 I-Team. —Fox 8
With Trump facing some eleventeen different trials — to say nothing of what they are doing to his inner circle — is there any message MORE critical to the success of the American Experiment than the simple fact that power is not a cudgel that people in government get to wield against people they hate?
You know, in the defence of ‘democracy’ and all… in this *ahem* Constitutional REPUBLIC.
